Terms & Conditions for "Reset"

1. Introduction

Welcome to "Reset," an app designed to help users process and reframe anxious thoughts by generating personalized reports based on user input. By using this app, you agree to the following Terms & Conditions. If you do not agree, please do not use the app.

This agreement is between you, the user, and Moment Apps Ltd., the provider of the app "Reset." Apple Inc. is not responsible for the app and its content, and you agree that Apple has no obligations regarding the app or its use.

2. Eligibility

"Reset" is available to users aged 9 and above. By using the app, you confirm that you meet this age requirement.

3. Scope of License

Reset grants you a limited, non-transferable, non-exclusive license to use the app on any Apple device you own or control, subject to the Apple App Store Terms of Service.

4. User Responsibility

Users are solely responsible for the content they input into the app. "Reset" is a self-guided tool intended to offer suggestions on reframing thoughts, but it is not a substitute for professional mental health services. If you are experiencing mental health issues, please consult a licensed healthcare provider.

You agree to comply with applicable third-party terms of agreement when using "Reset," such as your wireless data service agreement.

5. AI-Generated Advice Disclaimer

The AI-generated advice provided by "Reset" is designed to help users reframe their thoughts and gain new perspectives. However, the advice is not clinical or medical in nature. It is provided as guidance only and should not be relied upon for medical or therapeutic purposes.

To the maximum extent permitted by law, the app is provided "as is" and without warranties of any kind, either express or implied, including non-infringement, merchantability, or fitness for a particular purpose. Apple has no warranty obligations with respect to the app.

6. Data Storage and Privacy

All user input data is stored locally on your device and processed by OpenAI, which retains this data for up to 30 days to monitor for abuse. "Reset" also uses Firebase for analytics to monitor app usage. No personally identifiable information or input data is shared with our company. For more details on how data is handled, please refer to our Privacy Policy.

7. Data Deletion

Users have the option to delete reports stored locally on their device by:

  • Navigating to the "Past analyses" section in the app and clicking the trash icon next to the report they wish to delete.

  • Deleting the app from their device, which will remove all locally stored data.

8. Subscription and Billing

"Reset" requires a paid monthly subscription to access its full features. Payment is processed via Apple Pay, and the subscription will automatically renew unless canceled.

Free Trial

Users are offered a 1-week free trial upon subscribing. Please note that payment details are required to access the trial. Users must cancel their subscription before the end of the trial period to avoid being charged. There will be no explicit notification about the trial's end.

Cancellation and Refunds

Subscriptions can be managed or canceled through the Apple App Store. Upon cancellation, access to premium features will continue until the end of the current billing period. Refunds are not provided.

9. Prohibited Content

Users are permitted to add text content into the app, but this content is only visible to themselves. Any content that violates OpenAI’s terms of use is prohibited and may result in the suspension of app features or access.

10. Maintenance and Support

Moment Apps Ltd. is solely responsible for providing maintenance and support for the app. Apple has no obligation to provide any maintenance or support services with respect to the app.

11. Product Claims

Moment Apps Ltd. is responsible for addressing any claims from you or any third party relating to the app or your possession and/or use of the app, including, but not limited to:

  • Product liability claims,

  • Any claim that the app fails to conform to any applicable legal or regulatory requirement, and

  • Claims arising under consumer protection, privacy, or similar legislation.

12. Intellectual Property Rights

In the event of any third-party claim that the app or your possession and use of the app infringes that third party’s intellectual property rights, Moment Apps Ltd., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

13. Modifications to the Terms & Conditions

We reserve the right to update or modify these Terms & Conditions at any time. Any changes will be communicated to users via in-app pop-ups. Continued use of the app following these notifications constitutes acceptance of the modified terms.

14. Governing Law

These Terms & Conditions are governed by the laws of the United Kingdom. Any disputes will be subject to the exclusive jurisdiction of the courts of the United Kingdom.

15. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this agreement, and that upon your acceptance of the terms and conditions of this agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.
